What is Surrogacy?

Surrogacy is an arrangement in which a woman, known as the “surrogate” or “gestational surrogate,” agrees to carry a pregnancy and deliver a baby for another person or couple, who will be the legal parents of the child. This process is used primarily by couples who are unable to conceive naturally due to various factors, such as fertility problems, illness or lack of a functional uterus.

In surrogacy processes, the most commonly used method is in vitro fertilization (IVF), in which an embryo is created in a laboratory using the intended parents’ gametes or donor eggs and/or sperm, depending on the case. This embryo is then transferred to the surrogate’s uterus. The entire procedure is carefully supervised by medical professionals to ensure the health of the surrogate and the well-being of the future baby.

The surrogacy process involves several stages:

  • 1. Selection of the surrogate mother: Specialized agencies select women who meet the medical, psychological and legal requirements to become surrogate mothers.
  • Fertilization and pregnancy: Depending on the case, surrogacy is carried out through in vitro fertilization (IVF), using eggs from the intended mother or an egg donor, and sperm from the intended father or a sperm donor. The resulting embryo is implanted in the surrogate’s uterus, and the pregnancy is monitored by specialized medical professionals.
  • Monitoring during pregnancy: Throughout the pregnancy, the surrogate woman will receive constant medical care to ensure her and the baby's well-being.
  • 4. Birth of the baby: Once the baby is born, the intended parents, previously identified in the contract, will take legal place and custodial of their child, and the surrogate woman will no longer have parental rights.

Surrogacy is legally permitted in Colombia, but with certain requirements and regulations. It is important to note that, although the process is permitted, not all types of surrogacy are legal in the country.

 

In Colombia, the law does not allow surrogacy to be used for commercial purposes. This means that surrogate mothers cannot receive financial compensation for carrying the baby, except for medical and living expenses during the pregnancy. Colombian law also states that the process must be completely voluntary and involves the intervention of lawyers, doctors and psychologists.

 

The Colombian Civil Code establishes that the intended parents have legal rights to the child from the moment of birth. Therefore, the parents will be legally responsible for the child, regardless of whether the surrogate woman has given birth to the baby.

  • Informed consent: Both the surrogate woman and the intended parents must sign a contract that clarifies the rights and duties of each party involved, as well as the medical and financial conditions.
  • 2. Medical and psychological supervision: Throughout the entire process, the intended parents and the surrogate woman must receive medical care and psychological follow-up.
  • 3. Legal documentation: The necessary procedures must be carried out before the National Civil Registry Office to ensure that the intended parents are legally recognized as the child's parents.
