Surrogacy is an arrangement in which a woman, known as the "surrogate" or "gestational surrogate," agrees to carry a pregnancy and deliver a baby for another person or couple, who will be the legal parents of the child. This process is used primarily by couples who are unable to conceive naturally due to various factors, such as fertility problems, illness or lack of a functional uterus.

In surrogacy, two methods can be used: artificial insemination with the intended parents' gametes or the use of an egg from a donor and sperm from a man who is not the couple. The process is carefully supervised by medical professionals to ensure the health of the surrogate mother and the well-being of the baby.

The surrogacy process involves several stages:

  1. Selection of the surrogate mother: Specialized agencies select women who meet the medical, psychological and legal requirements to become surrogate mothers.
  2. Fertilization and pregnancy: Depending on the agreement, artificial insemination or in vitro fertilization (IVF) may be used to achieve pregnancy. The resulting embryo will be implanted in the surrogate mother's uterus.
  3. Monitoring during pregnancy: Throughout the pregnancy, the surrogate mother will receive constant medical care to ensure her and the baby's well-being.
  4. Birth of the baby: Once the baby is born, the intended parents, previously identified in the contract, will take legal and custodial possession of the child, and the surrogate mother will no longer have parental rights.
